Michigan suspends St. Clair County car dealership license over repeated code violations

The Michigan Department of State (MDOS) has suspended the license of LaFontaine Chevrolet Buick GMC of St. Clair, Inc., a vehicle dealership located at 3050 King Rd. in China Township, Michigan. The suspension was issued due to concerns about imminent harm to the public following an investigation by MDOS regulatory staff.

According to MDOS, the dealership violated several aspects of the Michigan Vehicle Code. These violations included breaking terms of an existing probation and an Alternative Penalty Agreement previously imposed by MDOS, committing fraudulent acts related to vehicle sales by presenting and selling used vehicles as new, and submitting false information on title and registration applications by listing used vehicles as new.

A compliance inspection in September 2024 revealed that the dealership registered new vehicles under its business name for use as loaner cars for customers. After being used as loaners, these vehicles were then resold to consumers as “new.” Violations were issued for these transactions.

In October 2024, both MDOS and the Michigan Auto Dealers Association sent emails directing all new vehicle dealerships to immediately stop selling used vehicles as new or face administrative action and possible license suspension.

On November 12, 2024, a teleconference was held between MDOS and LaFontaine Chevrolet Buick GMC of St. Clair, Inc. to discuss the inspection findings and provide educational materials. By December 2024, an Alternative Penalty Agreement had been established for the dealer that included a $3,000 financial penalty and an 18-month probation period. Several representatives from the dealership also attended an MDOS training session focused on violations of state law regarding vehicle sales.

A follow-up inspection on September 24, 2025 found more than two dozen additional cases where used vehicles with varying mileage—including one with up to 6,000 miles—were sold as “new.” This led to emergency action from MDOS.

“These violations created an imminent threat to the health, safety or welfare of the public, requiring emergency action,” according to information provided by MDOS. The department stated that during this suspension period, LaFontaine Chevrolet Buick GMC of St. Clair may not conduct any business operations.
