MICHIGAN CREDIT UNION LEAGUE: Gov. Whitmer Signs E-Notarization Legislation in Win for Credit Unions

Michigan Credit Union League issued the following announcement on Nov. 5

Today, Gov. Whitmer signed some new bills into law, including House Bills 6294-6297.

HB 6294-6297 will allow certain documents to be signed, witnessed and notarized electronically until Dec. 31, 2020. The bills amend the Estates and Protected Individuals Code, the Uniform Electronic Transactions Act, the Uniform Real Property Electronic Recording Act and the Michigan Law on Notarial Acts, respectively.

The bills have a primarily retroactive effect from April 30, 2020 and encourage the use of electronic signatures, witnesses and records where available. The bills were sponsored by Rep. Sarah Lightner (R-Springport).

This legislation is positive for credit unions because it allows them to continue to utilize electronic and remote notarization processes previously outlined in the executive orders through the end of the year.

These bills also ensure that the transactions that were conducted via electronic or remote notarization under those executive orders continue to be valid as the legislation is retroactive to April 30, 2020.
